                       SYNOPSIS: This bill would prohibit the operation of a motor vehicle while using a cellular telephone unless the operator uses a headset or a hands-free cellular telephone device.

A BILL

TO BE ENTITLED

AN ACT

To prohibit the operation of a motor vehicle while using a cellular telephone unless the operator uses a headset or a hands-free cellular telephone device. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. The following terms shall have the following meanings:

(1) CELLULAR TELEPHONE. A device capable of sending or receiving telephone communications without an access line, including, but not limited to, an analog, a digital, or a wireless telephone.

                        (2) HANDS-FREE DEVICE. An internal or external device, attachment, or addition to a cellular telephone or motor vehicle, regardless of whether the device is permanently installed, which allows the operator of the motor vehicle to maintain both hands, or prosthetic device or aid in the case of a physically disabled person, on the applicable steering device and to hear surrounding sound.

                         

                        Section 2. (a) No person shall operate a vehicle while using a cellular telephone unless equipped with a headset or hands-free device that provides sound only through one ear and allows surrounding sound to be heard with the other ear.

 

                         

(b) The Department of Public Safety shall provide, by rule, for standards and specifications for headset equipment and hands-free equipment which is permitted under this section. The department shall inspect and review all devices submitted to it and shall publish a list by name and type of approved equipment.

 

(c) A violation of this section is a traffic infraction punishable by a fine of fifty dollars ($50) as a nonmoving traffic violation.

 

 

Section 3. This act shall become effective on the first day of the next year following its passage and approval by the Governor, or its otherwise becoming law.
